Microsoft had to have known we were there.

  • A little over a week ago, Microsoft came out with a weblog offering called MSN Spaces.
  • A little over a week ago, my customers were calling me asking, "What is this MSN Spaces thing? Did you sell Spaces to Microsoft? I'm confused."

I work for a small web development company in Rochester, Michigan called Edict Incorporated. I started working for Edict in '95 and have been through all of the ups and downs of the web. This, apparently, is one of those rides.

Over the past two years, the Edict team has worked hard to create a weblog service called "Spaces". We've spent those last two years growing, marketing and creating a darn cool set of tools.

On December 2nd, Microsoft came out with a service that, not only was named the same as ours, but also had a product in the same marketplace as ours.

They had to have known we were there. Hell, if you typed in "spaces weblog" on December 2nd, we were there in the top 10 results on MSN Search.

To top it off, we are a "Microsoft Partner" with a freaking solution built on a "Microsoft Platform." They had to have known we were there and it hurts.

Anyway, we're having a hell of a time finding a west coast lawyer who is interested in taking this trademark infringement case. We are having the damnedest time finding one who isn't already working with Microsoft and would have a "conflict of interest."

If you know of any good IP lawyers, have dealt with Microsoft in the past or have any suggestions in general, please drop a line.

Catch me at Edict: 248-650-4962 or send me an email.
