The court finds that the City of Greensboro is authorized to fashion procedures for the initiation, amendment and repeal of zoning ordinances, and that the Greensboro City Charter provides for an Initiative Petition process and expressly assigns the City Clerk the responsibility of approving an Initiative Petition and specifically sets out the standards the City Clerk is to apply in reviewing and approving such an Initiative Petition. The Petition contained what was required, that is ‘the full text of the proposed ordinance’ and the City Clerk met her responsibility as set forth. It appears to the court tht there is no genuine issue as to any material fact and that the defendant is entitled to a judgement as a matter of law. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that summary judgement is granted in favor of the defendant against the plaintiff and that this action is dismissed with the costs to be taxed against the plaintiff. |
