This article in IEEE-Spectrum tells how ConsumerPowerline is taking advantage of a Federal Energy Regulatory Commission (FERC) ruling in January 2001 requiring that "organizations set up to manage deregulated and
restructured grids establish procedures for consumers to
sell saved electricity to the power system at times of
shortage." ConsumerPowerline does the analysis, sets up the meters and takes a cut of the "saved energy" sold.
